Or Forever Hold Your Peace: Releases in Insolvency

Kelsey Meyer and other Canadian and U.S. insolvency professionals speak on "Or Forever Hold Your Peace: Releases in Insolvency" at the 21st Annual Turnaround Management Association Northwest Chapter Cross-Border Conference. Kelsey is a featured panelist on the genesis, developments, and current issues in Canadian law on third party releases in Canadian insolvency proceedings, as well as cross-border recognition of third party releases by Canadian and U.S. Courts, referencing recent cases on the topic.

The panel discusses the distinctions between the Canadian and American approaches to third party releases and the potential impact, including on cross-border insolvency recognition proceedings, of a current bill proposed in the U.S. (the proposed Nondebtor Release Prohibition Act of 2021), which, if enacted, would prohibit a U.S. Bankruptcy Court from releasing a third party through U.S. bankruptcy proceedings.

Kelsey has considerable experience acting for Canadian debtors in cross-border insolvency recognition proceedings and has been a featured panelist at other international conferences on the topic.
