Mike Eizenga comments in Canadian Lawyer on the $1.4 billion class action lawsuit launched against the Beer Store that was dismissed by the Ontario Superior Court of Justice. Bennett Jones was lead counsel to the Beer Store.
Mike says the core of the case is the regulated conduct defence. “Our perspective was that virtually every aspect of the distribution and sale of beer is heavily regulated—the court was able to straightforwardly apply the existing jurisprudence to conclude we had a regulated conduct defence.”
