Blair Yorke-Slader talks with Canadian Lawyer about the Court of King's Bench of Alberta ordering NOVA Chemicals Corporation to pay Dow Chemical Canada a total of C$3.56 billion in damages.
The judgment relates to NOVA Chemicals’ operation of the companies’ jointly owned ethylene plant in Joffre, Alberta, Canada between 2001 and June 2018. Bennett Jones is representing Dow with a team led by Blair.
He explains that Dow was shortchanged in two essential ways. First, a court found that Nova was taking some of the ethylene that was supposed to be allotted to Dow for itself. Second, Nova wasn’t running the plant at full capacity, which is what Dow needed and was Nova’s duty to ensure.
