The Canadian Class Actions Handbook

On March 5, 2019, the Superior Court of Québec authorized (i.e., certified) a class action against the operators of various hotel booking websites. The plaintiff alleged that the defendants violated various provisions of the Québec Consumer Protection Act and the Regulation Respecting Travel Agents by failing to include hotel fees, establishment fees or resort fees charged directly by hotels (hotel fees) on certain website pages displaying search results for available hotels. In the reservation process, the hotel fees appeared only after a customer selected a particular hotel.

The Québec government recently adopted Bill 29, an Act to protect consumers from planned obsolescence and to promote the durability, repairability and maintenance of goods (the Act), which introduces several substantive amendments to Québec's Consumer Protection Act. The Act was assented to and came into force on October 5, 2023. For several years, the Canada Border Services Agency (CBSA) has sought to limit the ability of non-resident importers to self-assess duties, surtaxes and other taxes on imported goods based on their acquisition costs. In pursuit of this aim, the CBSA launched a third consultation in December 2025 that anticipates a fundamental reshaping of Canada's customs valuation framework through amendments to the&nbsp;Valuation for Duty Regulations, (SOR/86-792) (VFD Regulations).&nbsp;The deadline for stakeholders to make submissions to the 2025 VFD Consultation is January 23, 2025.
