At the 2013 CBA Legal Conference in Saskatoon, Munaf Mohamed co-presents, with David Debenham (McMillan LLP), "Litigating Civil Fraud Claims." The investigation and litigation of claims alleging dishonesty pose unique challenges for civil litigators. A panel consisting of two lawyers and one accountant will discuss three major challenges of dealing with civil fraud claims: effective detection and investigation of dishonest conduct, with a focus on considerations involved in searching for and securing evidence and interviewing the target; advancing claims of fraud and dishonesty in the courts, including when it is appropriate to plead dishonesty, problems of proof and potential costs; and strategic considerations in defending a civil fraud claim, such as whether and to what extent to cooperate during the investigation.
