Are You Ready? Deadline for Electronic Monitoring Policies Almost Here

October 11, 2022

Talia Bregman speaks with Canadian HR Reporter on the looming October 11, 2022 deadline for workplaces with 25 or more employees in Ontario to create a written electronic monitoring policy.

She says that if employers meet the threshold, they should ask themselves a number of questions.

“You must describe how do you electronically monitor employees? In what circumstances do you electronically monitor employees? And then what are the purposes for which you use the information you obtain through that? If the answer is no, your policy will be very simple and essentially say, ‘As of today’s date, we don’t monitor our employees via electronic means.’ That’s really it.”

Talia also comments on the amount of detail that is required in an electronic monitoring policy, examples of electronic monitoring, and how some employers are including the policy with new hire offer letters, “which is a good practice on that end and shows the 30-day time frame is met.”
