Dow Canada Awarded $1.3 Billion Judgment Against NOVA Chemicals

In a lengthy judgment issued June 20, 2018, the Court of Queen’s Bench of Alberta awarded more than $1.3 billion to Dow Chemical Canada ULC and an affiliate in a claim against NOVA Chemicals Corporation for conversion and breaches of contract arising out of the parties’ co-ownership of an ethylene faculty located at Joffre, Alberta over the period 2001 to 2012. The Court also made provision for a further award of damages for the period 2013 to 2018. Bennett Jones acted as lead counsel for Dow.
