Bennett Jones acted for Canadian Pacific Kansas City Limited (CPKC), one of North America's largest railway companies, in a successful appeal overturning a C$228 million judgment arising from a failed real estate transaction.
Bennett Jones assumed representation of CPKC following an initial trial decision issued in 2022. After assuming carriage, Bennett Jones completed the trial, obtained a stay of the judgment pending appeal and obtained an order from the Alberta Court of Appeal overturning the judgment and directing a new trial.
CPKC was represented by Munaf Mohamed KC, Ciara Mackey and Douglas Fenton, with assistance from other lawyers from across Bennett Jones' various offices.
