On August 10, 2006, the Employment Pension Plans Amendment Act,
2005 and the Employment Pension Plans Amendment
Regulation took effect, introducing a series of
long-anticipated amendments to the Alberta Employment Pension
Plans Act and the Employment Pension Plans
Regulation. These changes, several of which will require plan
sponsors to amend their plans, affect plans registered in Alberta
as well as plans registered outside of Alberta with Alberta
members.

Retirement Statute Law Amendment Act, 2005 comes into effect on December 12,
2006. Subject to some limited exceptions, as of December 12, 2006, provincially
regulated employers in Ontario will not be able to use mandatory retirement
policies to terminate the employment of older
workers.
New Tax Proposals for Income Trusts
November 08, 2006
It has been a week since the Federal Minister of Finance announced
a new taxing regime for publicly-traded income trusts and limited
partnerships. The stated goal of the announcement was to
“level the playing field” by stopping the spread of
income trusts by ensuring that corporations that were considering
conversions would abandon their plans, while at the same time
providing a limited shelf life for the tax benefits available to
existing income trusts and partnerships.

terminated when the litigation for which the privileged communications were

Alberta Securities Act To Be Amended To Provide For Secondary Market Civil Liability

The
Government of Alberta has opted to follow the lead of its Ontario counterpart
and amend the Securities Act (Alberta) to include a secondary market civil
liability regime. Bill 25, which includes a number of other amendments to the
Securities Act (Alberta), received third reading in the Alberta Legislature on
May 16, 2006 and royal assent on May 24, 2006.
Federal Dividend Tax Changes

On June 29, 2006 the Minister of Finance released draft legislation to overhaul the federal taxation of corporate dividends. The proposals were promised in the February Budget, and implement the general proposals made on November 23, 2005, by the previous Liberal government.
