Tort law is complicated generally. Who owes whom a duty of care,
and when that duty might be vitiated by policy considerations, are
not easy questions to answer. Contractual relational economic loss
is generally considered a subset of the tort of negligence and
magnifies these issues in a focused area of the law. This paper was
presented to the Litigating Commercial Damages course at Osgoode
Hall Law School.
