Chris Petrucci, in addition to being an effective advocate before the courts and in arbitration hearings, is very focused on helping clients develop and execute a strategy that meets their legal and commercial objectives.

Chris practices corporate and commercial litigation in a variety of industries with a special focus on energy (including power and oil and gas), construction and infrastructure, surety claims, shareholder disputes, mining, and real estate. Chris further specializes in obtaining prejudgment relief for clients, including interim injunctions and attachment orders.

Chris has extensive experience before the courts resulting in numerous reported case decisions where he appeared as lead counsel or co-counsel.  He has appeared before all levels of court in Alberta.

Chris also has an active alternative dispute resolution practice.  He has represented clients in various forms of dispute resolution involving Judicial Dispute Resolution, mediation, and arbitration, including international arbitration under multiple procedural regimes, such as UNCITRAL, ICC, IBA, and LCIA.

In addition to advocating for his clients before the courts and arbitral tribunals, Chris is regularly consulted to provide strategic advice to clients in connection with construction and infrastructure projects where disputes may be on the horizon.

Chris is an executive member of the Canadian Bar Association Construction Law Section - Alberta South and regularly speaks and writes on a variety of energy and construction litigation issues.  He is often requested to comment on updates on related legal developments, contractual interpretation of industry agreements, preparation of delay and cost overrun claims, procurement and tendering law, audit disputes, builders' liens and alternative dispute resolution.

In 2020, Chris was recognized as one of Canada’s leading infrastructure lawyers by Lexpert. He has also been recognized as one of Canada’s leading litigators by Lexpert and a future leader in construction law by Who’s Who Legal.

Among other pursuits, Chris enjoys playing team sports such as soccer and basketball.

International energy company, with claims in the hundreds of millions of dollars against its engineering, procurement, and construction contractor for cost overruns and delays associated with the engineering and construction of a billion dollar heavy oil extraction facility.

Construction contractor, with a pipeline construction dispute involving claims for extras and delay claims in the context of an international arbitration governed by the Arbitration Rules of the London Court of International Arbitration.

Surety under a performance bond, with a significant government infrastructure dispute before the courts involving claims for deficiencies and delay.

International contractor, regarding a dispute with its sub-contractor for multiple breach of contract claims in excess of $50 million in the context of an international arbitration governed by the Arbitration Rules of the International Chamber of Commerce.

Mining contractor, in the successful resolution of a multi-million dollar dispute over contested progress payments concerning the design and construction of a gold processing facility. 

Global engineering firm, in a successful application for summary judgment in relation to a multi-million dollar complex international construction dispute (Attila Dogan Construction v. AMEC Americas Limited, 2015 ABQB 120).

International construction company, with disputes with subcontractors over issues of delay, change orders, negligence, and breach of contract.

Various owners, contractors, and subcontractors, with builder's lien disputes, including taking steps to discharge a lien, or file a lien, in respect of various types of construction projects, such as oil sands development and urban construction projects.

Owner of a power generation facility, with an Originating Application brought by the Attorney General of Alberta to challenge the termination of certain Power Purchase Arrangements.

Oil and gas exploration and production company, in a dispute before the courts involving claims for breach of contract and misrepresentation in excess of $400 million.

Owner of a cogeneration power facility, in a dispute with its counterparty concerning the allocation of costs and revenues under the relevant agreements. 

Bio-fuel power generation facility, in a multi-million-dollar dispute over the overhaul of its turbine generator, which included issues concerning summary judgment and limitation periods applicable to third party claims (Whitecourt Power Limited Partnership v. Elliott Turbomachinery Canada Inc., 2015 ABCA 252).

Large oil and gas companies, in an international arbitration governed by the UNCITRAL Rules concerning a dispute over certain cost allocations in respect of an oil development that required a week of hearings.

Oil company, in a dispute over title to oil and gas leases.

Oil and gas producer, in an action against a third-party facility operator involving a pipeline leak.

Operators and non-operators, with various accounting disputes involving joint interest billings, applicable accounting procedures, and audits.

Selling shareholders, with the purchase and sale of oil and gas assets in an action involving allegations of misrepresentation and breach of contract.

Commercial landlord, in a court action against a former landlord to pursue claims in relation to the early termination of a commercial lease.

Commercial developer, in the defence of claims related to the development and sale of condominium units. 

Real estate brokerage firm, in the successful defence of an injunction application where the applicant had made allegations of breach of trust conditions in relation to a condominium development.

Large department store tenant, in obtaining an interlocutory injunction against a landlord related to a shopping mall development (Zellers Inc. v. First Capital Holdings (ALB) Corporation, 2009 ABQB 712).

Tenant, at trial as lead counsel, in which the plaintiff's claim for rent was dismissed (Mission Centre Ltd. v. First Capital Leasing Ltd., 2011 ABPC 394).

Various landlords, with recovery of rent, including seizure of tenant's assets.

Selling shareholders, with the successful release of $40 million of holdback funds that were frozen pursuant to the governing share purchase agreement.

End user of industrial equipment, with a claim for defective manufacturing and defective repair work.

Large industrial engine manufacturer, in defence against claims of alleged defects.

Internet marketing company, as lead counsel at trial in the Alberta Court of Queen's Bench, in obtaining judgment against the defendant counterparty in relation to a failed business venture involving a breach of a letter of intent.

Restaurant services company, successfully obtained a mareva injunction and attachment order in relation to the supply and distribution of food items which resulted in freezing the defendant's assets.
