Updated Rules for Mining Disclosure: What the Canadian Securities Administrators Proposed Changes Mean for Industry Participants

On September 26, 2023, the British Columbia Supreme Court issued a ruling in <a rel="noopener noreferrer" href="https://www.canlii.org/en/bc/bcsc/doc/2023/2023bcsc1680/2023bcsc1680.html?autocompleteStr=gitxaala%20v%20brit&autocompletePos=2" target="_blank">Gitxaala v. British Columbia (Chief Gold Commissioner)</a> that will affect the future of mining in British Columbia. In this case, the court found the administration of the province's mineral tenure regime to breach the Crown's duty to consult with Indigenous peoples. The decision requires the Province to amend its mineral claims system to address the lack of consultation with Indigenous peoples prior to the granting of a mineral claim; something the Province was already in the process of addressing.

While aimed at curbing harmful online promotion, including by &ldquo;finfluencers,&rdquo; the amendments also have important implications for reporting issuers and their disclosure practices.
