Ontario's Ministry of the Environment issued its first ever environmental penalty order to CGC Inc. in February 2008. Julia Schatz and Sarah Gilbert explore the circumstances surrounding the inaugural use of this regulatory tool and examine the Ministry's formulaic determination of the amount of the penalty.
