Jason Roth is head of the firm's construction law practice group. Jason practises law related to infrastructure development projects. He represents owners/developers and contractors in relation to domestic and international infrastructure, LNG, power and renewables, electrical transmission, pipeline, natural gas processing, agriculture, mining, and other projects.
Jason provides strategic advice, structuring, and drafting and negotiation of design/build, engineering, procurement and construction (EPC), engineering and procurement (E&P), engineering, procurement and construction management (EPCM) and owner-managed contracts related to such projects. He also assists clients with procurement and supply chain matters as well as contract administration issues such as change order management and warranty issues.
From 2005 to 2006, Jason was in-house project counsel for the Qatar Liquefied Gas Company Limited (II) Project in Doha, Qatar. The US$12-billion project supplies 15 mpta of liquefied natural gas from Qatar to the UK and north Europe.
Jason is a member of the Canadian Bar Association construction practice section, a member of the British Columbia Construction Roundtable (BCCR) and a fellow of the Canadian College of Construction Lawyers.

New B.C. Tower Crane Requirements in Effect October 1, 2024

On October 1, 2024, WorkSafeBC introduced new regulations (the Crane Regulations) regarding tower crane safety which amend Part 14 of the Occupational Health and Safety Regulation in British Columbia. The Crane Regulations will require every employer responsible for tower crane activity to submit a Notice of Project–Tower Crane to WorkSafeBC and to ensure a qualified supervisor is in place.

BC Hydro 2024 Call to Power—Overview of Request for Proposal Documents

On June 15, 2023, the Government of British Columbia announced BC Hydro was proceeding with a call for new sources of 100 percent clean, renewable emission-free electricity from large-scale projects, notably including wind and solar. Spring Has Sprung in Alberta With New Agri-Processing Tax Credit

Alberta is launching a new agri-processing tax credit in Spring 2023 to attract new large-scale investment to the sector and expand opportunities for primary producers. The Alberta Agri-Processing Investment Tax Credit will provide a 12 percent non-refundable tax credit against eligible capital expenditures for corporations investing $10 million or more to build or expand agri-processing facilities in the province. This initiative will be introduced in Alberta's 2023 Budget, which is scheduled to be delivered on February 28, 2023.

Land Rich, Cash Poor: The Impacts of the PPCLA and Statutory Trusts on Builders' Liens

The PPCLA permits the removal of a lien where security is given or payment is made into court to stand in place of the project lands. The PPCLA also imposes a trust over funds paid out after the issuance of a certificate of substantial performance with the recipient holding such funds in trust for unpaid subcontractors and suppliers.
In Tempo Alberta Electrical Contractors Co Ltd v Man-Shield (Alta) Construction Inc, 2022 ABCA 409, the Alberta Court of Appeal considered the interplay between these provisions and held that where funds paid into court to discharge a lien are impressed with a statutory trust, the payor cannot replace the funds with a lien bond.

EPC Contract: Love it or Leave it

The Engineering, Procurement and Construction (EPC) delivery model is common for large-scale and complex public and private infrastructure projects. However, given the size of these projects, the terms and conditions, and compensation models of typical EPC contracts, the model includes many risk allocation disputes. These risks can invite an adversarial approach to the contractual relationship, increasing transaction costs, and lengthy and costly dispute resolution. If this is known, these costs may be built into the pricing at the risk of an EPC not being successful in winning the work. Prompt Payment Legislation Coming Soon to an Alberta Construction Project Near You

Cash flow and payment delays due to disputes are a critical concern for construction companies who rely on the timely receipt of funds to maintain operations and pay subcontractors and suppliers. The introduction of prompt payment legislation is intended to address these issues. On October 21, 2020, following other Canadian jurisdictions, Bill 37, Builders' Lien (Prompt Payment) Amendment Act, 2020, passed its first reading in the Legislature of Alberta. If Bill 37 receives royal assent, it will, following proclamation, amend Alberta's Builders' Lien Act (BLA) and become the Prompt Payment and Construction Lien Act.
