Canada Contemplates Changes to Its Competition Laws

Zee Derwa comments in Law.com on the mention in Canada's 2022 federal budget that has competition lawyers thinking about what changes the government will actually make to the Competition Act—and if changes are even necessary.

The budget announced there would be legislative amendments to the Competition Act as "a preliminary step" in the planned modernization of the competition regime.

Zee says that allowing private rights of action for abuse of dominance is an aspect that is likely to be amended. Currently, only the competition commissioner can initiate an abuse of dominance regime application.

The biggest shift may look at the Competition Act in light of the digital economy's transformation of the business landscape. Zee says the competition regime must be reviewed to "align with the modernized economy because it hasn't been updated in years. But it should be done in a careful fashion."
