Bennett Jones in Lexpert's Top 10 Business Decisions of 2024-25

Bennett Jones acted for the defendants in one of Lexpert's Top 10 Business Decisions of 2024–2025 in Cheng v. Glencore plc et al., in which we successfully had a putative representative action seeking nearly C$800 million in damages for alleged oppression dismissed on jurisdictional grounds.

This case is notable as it is the first Canadian appellate decision defining the territorial scope of the corporate oppression remedy. The Yukon Court of Appeal held that Yukon courts lack jurisdiction over oppression claims once a corporation discontinues under the Yukon Business Corporations Act, clarifying that such claims must be pursued in the corporation’s new jurisdiction.
