With the November economy on a downward trend, and few players willing to provide debtor in possession financing and restructuring monies, income streams are becoming harder to find. This paper, presented to the 18th Annual Construction Superconference, builds on and responds to questions from a paper presented to the 17th Annual Construction Superconference, with an emphasis on the Bankruptcy and Insolvency Act.
