In the January 2011 edition of Lexpert, where the publication rates its Top 10 Business Cases of 2010, Claire Kennedy comments on GlaxoSmithKline Inc. v. The Queen. Claire suggests that the court's decision is a victory for taxpayers: "What is important is the Federal Court's acknowledgement that transfer-pricing decisions don't exist in a vacuum and don't operate outside business realities... Here, the circumstances did not arise out of the non-arm's-length relationship between Glaxo and Glaxo group, but from the business realities imposed by the market power of the product."
