The Competition Bureau has nearly three years of experience enforcing the new provisions of the Competition Act, following a massive overhaul of the Act in 2009. For example, the recent Maple Transaction highlighted changes to the merger review process. The Bureau's new power to levy significant administrative monetary penalties has led to a number of high profile disputes and settlements in the real estate and telecom sectors. In addition, we have seen the growth of class actions pursuant to the Competition Act. The limits of the new price maintenance provisions are also being tested in a challenge to the setting of interchange fees in the financial services sector.
