Kyle is a leader in the area of commercial real estate, having acted on some of the country's largest transactions. Kyle maintains a diverse commercial real estate practice covering all aspects of transactions including routinely advising clients in connection with purchases, sales and financings, sale/leaseback transactions, lease securitizations, mortgage bond and debenture issuances, limited partnerships and other joint-venture arrangements, private equity and mortgage investment funds, commercial leasing and design-build transactions.
Kyle has been involved with many high profile transactions, including acting as counsel to a consortium which acquired 17 shopping centre properties from Primaris Reit, for the purchaser of a $2 billion industrial real estate portfolio comprised of over 400 properties, for the lead agent in connection with the $1.23 billion financing of the acquisition and leaseback of seven federal office properties from the Government of Canada, in respect of the issuance of $1.2 billion of debentures guaranteed by a pension fund (being the first ever transaction of its kind in Canada), as well as acting as co-lead negotiator for the Province of Ontario in connection with its negotiated land-swap settlement with developers respecting lands comprising part of the Oak Ridges Moraine.
- Lead counsel to the purchaser of a 90 property portfolio of CIBC banking centre locations across Canada as part of a sale/leaseback transaction.
- Co- counsel to the joint venture between KingSett Canadian Real Estate Income Fund LP and Alberta Investment Management Corporation in connection with the acquisition of a 50% interest in Scotia Plaza, Toronto from Dream Office REIT and H&R REIT.
Counsel to the borrower in connection with a $200 million first-ranking acquisition credit facility with respect to the purchase of 2 Bloor Street West and Cumberland Terrace, Toronto.
