Daniel Gallagher's practice involves corporate litigation, manufacturer's and product liability, insurance law (including as it relates to product liability claims), construction law, land related litigation, securities law, logistics law, property claims, fires and gas explosions, oil and gas law, international commercial arbitration, and alternative dispute resolution. Dan has been counsel in more than 40 Court of Queen's Bench trials over his 36 year career.

Former head of the firm's alternative dispute resolution/arbitration practice, he has extensive experience drafting international arbitration clauses and acting in arbitrations.

Dan is a frequent speaker, author and presenter on chambers' applications, rules of procedure, litigation precedents, land-related litigation, alternative dispute resolution, and international commercial arbitration.

Dan has authored revisions, supplements and other publications for the Legal Education Society of Alberta, including Alberta Court Forms, Chambers' Practice, and other publications that are used in various courses, including the bar course and a course given to members of the judiciary of the Province of Alberta. He is also author of numerous articles on "Drafting Arbitration/ADR Clauses - For Use in Domestic and International Contracts," "ADR Developments and Future Directions in the Energy Sector" and "Trends in ADR: An Alberta Perspective."

Dan is a past president and chairman of the board of directors of Heritage Park Society (Canada's largest historical theme park) and was in that role at the time of the commencement of the recent expansion of Heritage Park. He is a member of the board of directors and chair of the Legal Education Society of Alberta and chaired a subcommittee of the ADR committee of the Calgary Chamber of Commerce from 2000-2002, which met with and provided recommendations on the increased, beneficial use of ADR processes within the Alberta courts. At the request of the Law Reform Institute of Alberta, Dan drafted the forms that accompany the new Alberta Rules of Court that came into effect on November 1, 2010.

Select Experience

  • Successful prosecution of action for plaintiffs against structural engineers for negligent seismic and gravity load design of a luxury home resulting in a judgment of over $1.9 million plus recovery of costs of approximately $730,000: Swift v. Tomecek Roney Little & Associates, 2014 ABCA 49 reversing 2012 ABQB 764. (leave to appeal to Supreme Court of Canada refused August 7, 2014)
  • Numerous product liability claims, including claims involving reciprocating compressors, turbomachinery, expanders, valves for gas pipelines, natural gas piping, natural gas systems and additives in gasoline.
  • Numerous fire and gas explosion cases involving large property damage claims.
