International Commercial Arbitration

As the global economy continues to be driven by transactions and agreements that cross international borders, there continues to be an increase in the demand for alternative dispute resolution processes outside the traditional litigation forum. As one of the original countries to implement the Model Law on International Commercial Arbitration adopted by the UN Commission on International Trade Law (UNCITRAL), Canada offers a strong international reputation and an attractive venue for international commercial arbitration.

In particular, Bennett Jones has a history of advising domestic and international clients on their international commercial disputes. The lawyers in our international commercial arbitration practice are experienced in both institutional arbitrations, such as those administered by the International Chamber of Commerce (ICC), and ad hoc arbitrations, like those under the UNCITRAL Arbitration Rules. While our lawyers have frequently been appointed as arbitrators in a broad range of matters, we have particular expertise acting as counsel in energy, construction and international trade and investment disputes.

Our practice is bolstered by the experience and insight of the Honourable John C. (Jack) Major, Q.C., who rejoined the firm in 2006 after 14 years as a Justice of the Supreme Court of Canada.
