Jennifer Miller's practice is dedicated to significant legal matters involving health and safety in Western Canada.

Her practice includes:

  • occupational health and safety risk and incident management;
  • defence of occupational health and safety prosecutions;
  • health and safety related negligence litigation and public inquiries;
  • defence of professional discipline; and
  • a wide range of employment matters.

Jennifer represents industry leaders in energy, medicine, utilities, construction, road building, transportation, and manufacturing and appears before all levels of courts in Alberta, as well as courts in other jurisdictions on provincially and federally regulated matters.

Jennifer speaks and writes on health and safety issues for educational organizations, corporations, and professional associations, including the Alberta Medical Association, the Canadian Bar Association, Printers and Graphics Industry Association of Alberta, Alberta Gas and Oil Pipeline Operators Safety Council, Alberta Petrochemical Safety Council, Plant and Engineering Maintenance Association of Canada, Alberta Sand and Gravel Association, and Gas Processing Association of Canada.

She has contributed to international, national, and local publications on medical-legal issues, including the Health Law Review, the Health Law Journal, and Mental Disability and the Law in Canada.

Jennifer is a former chair of the labour and employment law subsection of the Canadian Bar Association, a former executive for the Edmonton Medical Legal Society and a former associate of the University of Alberta Health Law Institute.

She is an honorary member of the Ophthalmologic Society of Alberta and a keen supporter of the arts community.

    On December 1, 2021, sweeping changes to Alberta's current occupational health and safety legislation will come into force. The new laws rectify many of the previous challenges that arose from ambiguous and overly prescriptive statutory provisions, but in the short term, the revisions will constitute yet more change for employers already struggling to adapt their workplace policies and procedures to the ongoing pandemic. While there are many alterations to Alberta's existing occupational health and safety legislation, this article only addresses a number of the material changes.

    Bill 30: An Act to Protect the Health and Well-being of Working Albertans (the New Act), received its first reading in the Legislative Assembly of Alberta on November 27, 2017. If enacted in its current form, the New Act will materially alter Alberta's Occupational Health and Safety Act (the Current Act) and expand the nature of the health and safety obligations owed by employers and businesses in Alberta. The New Act states that, subject to certain exempted provisions, it will come into force on June 1, 2018.

    On October 7, 2015, we wrote about numerous changes that were being made to BC's Workers Compensation Act (WCA) pursuant to Bill 9 (see Recent Amendments to the Workers Compensation Act give WorkSafeBC Enhanced Compliance Powers). The amendments that came into force under Bill 9 greatly enhanced WorkSafeBC's powers with respect to the enforcement of occupational health and safety compliance. These amendments brought significant change; but more was on the way. Further amendments to the Act are being introduced under Bill 35.
